No residency for fraud or visa over-stay cases

Foreign nationals who have provided incorrect or misleading information in admission procedures will no longer be entitled to stay in the Netherlands.

The Dutch Government has agreed to a proposal tabled by Justice Minster Ernst Hirsch Ballin to amend the Dutch Immigration Act accordingly.

Foreign nationals who over-stay their visa or who otherwise reside illegally in the Netherlands will also no longer be eligible for residence permits.

The new grounds for refusing admission will automatically be included in the accelerated MVV procedure for an authorization for temporary stay, whereby immigrants are reviewed before they leave for the Netherlands.

The amendment is in line with the European directive on family unification.
