If a medical device suddenly becomes unavailable after Brexit, can the Dutch government intervene?
If the UK leaves the EU with a withdrawal agreement, the availability of your medical devices will not be affected.
- In the event of a 'no deal' scenario, certain medical devices from the UK may no longer satisfy EU rules.
- In principle, the care provider and supplier should find a suitable alternative.
- If there is no alternative and this would result in a life-threatening situation, the government can authorise the use of a medical device that does not satisfy all the legal requirements. An exemption is only possible under strict conditions and in the interests of public health.
