Exclusion orders

In certain cases migrants who are no longer permitted to remain in the Netherlands may be subject to an exclusion order, for example if they are in the Netherlands illegally and have committed multiple crimes, or pose a threat to public policy or public security. 

Temporarily lifting an exclusion order

The IND can temporarily lift an exclusion order in the following highly exceptional and urgent circumstances:

  • in the case of urgent family circumstances;
  • if the person has an obligation to testify at a trial in the Netherlands;
  • if the person has an obligation to come to the Netherlands for their own trial.

The migrant must demonstrate that at least one of these situations applies.
Once the migrant has done what is necessary, they are obliged to leave the Netherlands again.
