Can my employment be terminated when I reach 65?

Your employment can only be terminated once you reach state pension age. Since 1 January 2013, this is later than 65. Collective labour agreements or employment contracts stating that your employment will be terminated once you reach 65 contravene the Equal Treatment in Employment (Age Discrimination) Act. You can ask a court to reverse your dismissal.

Reversing dismissal at state pension age

Has your employment been terminated against your wishes when you reached 65? If so, you have two months to ask a court to reverse your dismissal. You can also apply for financial compensation. The court will decide how much compensation you receive.

Termination of employment before state pension age

Termination of employment before state pension age is only permitted if there is good reason for it. For example, firefighters may have to retire before state pension age in the interests of their health and safety. The Netherlands Institute for Human Rights determines whether someone can be dismissed before state pension age. The courts can also decide this.
