I am a foreign employer. How do I provide notification of the arrival of foreign workers?

As a foreign employer, you must provide notification of work to be performed and of the arrival of employees coming to the Netherlands on a temporary assignment. You can do so in the Dutch online notification portal (postedworkers.nl).

Who has to provide the notification?

The duty to notify applies to self-employed persons in certain sectors and employers from the European Economic Area (EEA) and Switzerland with a temporary assignment in the Netherlands. Foreign employers should also provide notification of any employees they may be bringing to the Netherlands to do the work in question. Employees do not have to provide notification of their arrival themselves.

What information do I have to provide?

In the online notification portal, you must give information about:

  • your identity;
  • your company;
  • the identity of your client or company in the Netherlands;
  • the identity of any employees coming to work in the Netherlands temporarily;
  • the details concerning the contact person;
  • the identity of the person responsible for paying employees’ wages;
  • the expected duration of the work;
  • the sector in which you will be working in the Netherlands;
  • the address/place where the work will be performed;
  • social security contributions.

If you have an assignment in the Netherlands but do not yet know the exact location, provide the information you do have and add more details later. The notification must be made before you start the work in the Netherlands.

Amending a notification

If the services provided change after they are first notified, you must amend the notification. This could be because an extra worker is being posted or the assignment is taking longer than planned. You can amend a notification at any time. However, the original data will be saved. This ensures that what was originally notified and what has been amended can still be viewed. The client receives a message when the notification is amended and must check the notification again at that time.

Who can be a designated contact person and what is their role?

Only natural persons can be a contact person, not an administrative office. However, a natural person employed by an administrative office can be a contact person. A posted worker may also be a contact person if they can be reached by the Dutch Labour Inspectorate throughout the period when services are provided in the Netherlands.

This person is the point of contact in the Netherlands for the foreign employer or foreign self-employed person. This person must therefore be in the Netherlands to answer questions from the Dutch Labour Inspectorate about the posting. The designated contact person must also be authorised to send and receive documents regarding the posting.

If a worker has dual nationality, which nationality do I give in the notification?

It is up to the workers themselves to choose which nationality they give. However, anyone wishing to work in the EU without an employment permit must have the nationality of one of the EU member states.
